Walk into a model home in Katy or Cypress and you will meet a friendly, knowledgeable sales consultant. They know every floor plan, every incentive and every lot. What they are not is your agent. They work for the builder, and their job is to sell the builder’s homes on the builder’s terms.
That is not a criticism. It is simply how the transaction is structured. The question is whether you want someone on your side of the table, too.
What the builder’s sales consultant does (and doesn’t do)
The on-site consultant can explain plans, options, pricing and the purchase process. But they are paid by the builder, they negotiate on behalf of the builder, and the contract you sign is drafted by the builder’s attorneys. They will not tell you that the community down the road has a lower total tax rate, that a competing builder offers a stronger warranty, or that a particular lot backs to a future commercial site.
What a buyer’s agent does in a new-home purchase
A good new-construction buyer’s agent adds value in places most buyers don’t expect:
- Before you tour: narrowing communities by commute, schools, total tax rate and budget.
- Builder comparison: construction quality, included features versus upgrades, and warranty terms.
- Negotiation: closing-cost credits, design-center allowances, price reductions on inventory homes, and lot premiums.
- Contract review: flagging deposit, delay, change-order and dispute-resolution clauses for you and your attorney.
- Inspections: coordinating independent inspections at key construction phases.
- Walkthrough and punch list: holding the builder to the standard you paid for.
- After closing: reminding you to schedule an 11-month warranty inspection before first-year coverage ends.
Who pays the buyer’s agent?
In most Houston new-home communities, builders offer compensation to cooperating brokers who bring buyers. Since 2024, buyers working with an agent sign a written buyer representation agreement that states how the agent is paid. We confirm each builder’s co-broker policy up front so there are no surprises, and in the typical case, the builder’s compensation covers our fee.
The rule that catches buyers off guard: registration
Many builders require your agent to accompany you, or to register you, on your first visit to the community or model home. If you walk in alone and fill out a guest card, the builder may decline to work with an agent later. If there is any chance you want representation, contact your agent before that first visit.
Does using an agent change the price?
Builders price homes to account for co-broker compensation in their marketing budgets. Buyers who come in unrepresented generally do not receive a discount equal to that amount. What an agent can do is help you negotiate the incentives, upgrades and terms that are actually available.
When you might not need an agent
If you have bought new construction before, know the community well, understand builder contracts and are comfortable managing inspections and the punch list yourself, you may decide to go it alone. Most buyers, especially first-time new-home buyers and those relocating to Houston, benefit from representation.
Frequently asked questions
Can I add an agent after visiting a builder’s model home?
Sometimes, but many builders won’t recognize an agent who wasn’t present or didn’t register you at the first visit. Contact your agent before touring.
Will the builder give me a discount if I don’t use an agent?
Generally no. Builders budget for co-broker compensation, and unrepresented buyers rarely receive an equivalent price reduction.
Do I have to sign a buyer agreement for new construction?
Yes. Since 2024, buyers working with an agent sign a written buyer representation agreement that states compensation before touring.
